Unfortunately domestic violence is common in England and Wales. Research suggests that 1 in 4 women have been the victim of domestic violence at some point in their lives. Legal Funding
You may be entitled to legal funding from the Legal Services Commission. This is dependent upon your means. The financial limits on income have been extended for applications in Domestic Violence and the merits of your case.
If you are eligible for Public Funding on financial grounds and are the Respondent to a non molestation application then you will not normally be granted funding to defend. However you may obtain funding to defend an occupation order because your occupation of your home is at risk. A respondent will also obtain funding for a committal hearing (providing he or she qualifies on means) because the individual’s liberty is at risk.
Fear of Violence
If you or your children are at risk of violence and you have nowhere to escape to, you should be offered temporary accommodation at a refuge from Women’s Aid. You should also be granted priority as a homeless person on council housing list.
